Most legal experts I've seen discuss this have said that ICE agents do not have blanket or absolute immunity from criminal prosecution or civil lawsuits. Contrary to what Vance and Miller have said recently they are not immune from prosecution if they break state or federal law.

The question is one of qualified immmunity or absolute immunity.  Generally the trend has been toward qualified immunity meaning if officers violate CLEARLY established law (a high standard of review) or if they act outside the scope of their employment and duties they lose their immunity.  It is an interesting argument if absolute immunity continues to hold anywhere and if it does is it the officer's immunity or the Department's immunity and can either the Officer or the Department waive it, and if so for whom.  Also does that immunity go to criminal cahrges or civil filings.

This admin won’t charge them federally, but my understanding is they could certainly be charged by states

The guy was just standing there with his cell phone.

The poorly trained, overzealous goons who aren't law enforcement attacked him, roughed him up, put him on the ground and shot him to death.

This was murder, and anyone who justifies it is complete low-life scum who can't use their own eyes and think for themselves.

This guy probably shouldn’t have brought a gun to a protest either, doesn’t mean it’s OK to kill him, and most people don’t think Rittenhouse should have been killed either.

We also don’t know if this guy actually “confronted” them.  Unless you think recording them is “confronting” them.  But considering you think protesting is a “lack of civility” maybe you do

Not following federal officer instructions, especially if it involves resisting, obstructing, or interfering with their duties, is a federal crime under 18 U.S.C. § 111 and related statutes. Such actions can lead to fines and imprisonment, with penalties escalating to 8 years or more if physical contact or dangerous weapons are involved.

DHS said he attacked agents who fired in defense.  They also said the FBI will not investigate, only DHS will investigate.
