That was my intended subject, but as always threads take on a direction of their own.

 

I find the undefined terms in section three particularly fascinating and tyroubling.  I tend to interpret them in light of the undersdtanding of that day not our own.  The terms i find most interesting are: engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.  These terms are so wide open you could drive a convoy of trucks through ther openings.  There is so little specific direction there as to give no warning nor to place no one on notice of what is prohibited, which is a constitutional problem.

 

I also find the provision interesting as most amendments preserve rights, rights preexisting.  Few amendments diminish rights or restrict matters and when they do they restrict government, generally, not the people.  The amendment is not entirely singular, but it is fairly unique, and therefore interesting.

The podcast is from a conference on the implications of Section 3 disqualification held at the University of Minnesota Law School. This podcast one of the panels. 

 

I’m left with these thoughts:

71 million people want to vote for Trump and they have the right to do that.

Section 3 disqualification should be used only if we were under threat of civil war.

Trump and Trumpism are an immediate threat to American democracy and needs to be voted into oblivion.

Preventing Trump from being on the ballot would go a long way toward shutting down the biggest concerns domestically. At least until the MAGA terrorists start FAFOing.
