Jacobson was a case involving smallpox vaccines. It ruled the state could enact legislation forcing vaccines for the greater good.

The appelate court overturned that ruling and said jacobson did not apply because the palintiffs made a plausible case that the covid vacccines were not traditional vaccines that prevent spread, but instead were medical treatments.

The court acknowledged they do not “effectively prevent the spread,” but in that very statement called them vaccines.
