He is being pedantic, he is saying that unless the Constitution specifcally spells out it in black and white, then it is not in the Constitution.

Fun Fact: SCOTUS has found a right to privacy under the Constitution, although it is not mentioned in the main document or any amendment. 

By the same token if SCOTUS has ruled that aliens who have entered the country come under the protective scope of the Due Process Clause, then they are saying that they are accorded protection under the Constitution (albeit indirectly).

I suppose @Strike may try to claim my use of the word “just” deport him implied I was saying they could deport him with no further hearings, but I never said that.

Of course the additional option that the government has to try to deport him is to get the withholding of removal, removed, so that he can actually be deported to El Salvador

To clarify, what exactly don’t you believe about this story?

-that he’s gay?

-that he has no criminal record?

-that he’s not in Tren De Aragua?

-that he entered the US at a legal port of entry?

-that he was sexually abused in CECOT?

This gay dude probably would have been a better example for Dems to use than Abrego Garcia (I know there were some stories about him when the folks were first sent to CECOT but then they kinda died off).  

-Being gay gives him a legitimate argument for his asylum claim.

-I’d be surprised if Tren de Aragua accepts gays as members, so his claim of not being in a gang is easy to believe.

-Entered the US at a legal port of entry and has no criminal record

I don't think a gay makeup artist would have made a better poster child (so to speak) than a married man whose wife is pregnant (and there would be people here calling for him to be deported just because he is gay). But Abrego Garcia caught the attention of the public first, so the media had to keep the focus on him rather than adding another story line to the mix.
