Trump signs an executive order to ban burning of the US flag

Pardons for January 6 rioters

  • Violent crimes were not pardoned. Donald Trump, upon re-entering office in January 2025, did issue broad pardons for some individuals involved in the January 6, 2021, attack. However, these pardons did not extend to everyone and notably included commutations for convicted leaders of extremist groups like the Proud Boys and Oath Keepers.
  • Assaulting police was still punished. The claim that assaulting a police officer with a flag or any weapon was pardoned is false. As of early 2025, there was no blanket pardon for violent offenses against law enforcement. Individuals who were convicted of assaulting officers during the riot, including one who used a stun gun and another who pleaded guilty to assault, received substantial prison sentences.

AI Overview

As of January 20, 2025, President Donald Trump issued sweeping pardons and commutations that covered all individuals, including those who assaulted police, convicted of offenses related to the January 6, 2021, attack on the U.S. Capitol

. The presidential proclamation applied to everyone charged in the investigation, making no distinction between those who committed violent acts and those with lesser offenses.

While I don't ever want to see anyone burn our flag, I also don't want to lose our freedoms.

It's as simple as this.

People need to stop getting offended so easily. It is well within my rights to burn an American flag. It is well within your rights to call me out for it. It's little different than burning a damn bra or pair of socks.

And before anyone gets huffy about what the flag stands for, the value placed on inanimate objects is subjective. I have 20 old concert t-shirts I value way more than the flag bought at Costco that I put on my house a few times a year.

I wouldn't call it a done deal, this court has shown very little respect to past precedent and that was only a 5-4 decision.

Donald Trump vs. Antonin Scalia on burning the American flag

The decision cut across ideological lines, according to CNN’s chief Supreme Court analyst Joan Biskupic.

Brennan, who wrote the decision, was a liberal, but the five-justice majority included the frequent swing vote Justice Anthony Kennedy and the strident conservative Justice Antonin Scalia.

In an email, Biskupic explained how the case split the justices:

Kennedy, who sealed the majority, wrote a concurring statement, saying, “The hard fact is that sometimes we must make decisions we do not like. We make them because they are right, right in the sense that the law and the Constitution, as we see them, compel the result.

Dissenting justices were deeply offended. In the lead dissent by then-Chief Justice William Rehnquist, joined by Justices Byron White and Sandra Day O’Connor, the chief emphasized that for more than two centuries the American flag has held “a unique position as the symbol of our Nation, a uniqueness that justifies a governmental prohibition against flag burning … .” Rehnquist laced his opinion with literary tributes to the flag, including the poem Francis Scott Key wrote as the British were firing on Fort McHenry during the War of 1812 that became the national anthem.

Justice John Paul Stevens, a liberal who was the fourth dissenter, wrote separately. The former Navy officer who earned a Bronze Star during World War II, said that even if prior court rulings could shield flag burning as symbolic speech, “this case has an intangible dimension that makes those rules inapplicable.”

That troubles me too given the current composition of SCOTUS, but the court corrrectly ruled at that time that burning the flag represented "symbolic speech."

I remember arguments raised at the time in favor of the decision that prosecuting someone for flag desecration was a "slippery slope" and might also cover buring other representations of the flag (for instance clothing items comprised of elements of the flag (stars, stripes, and flag colors).

Meh....Not a fan of this.   I would never desecrate our flag, but I support people doing it if that's their method of protesting

I don't support it, but I'm more upset about the government arresting anyone for it.

And talk about creating the problem you're trying to solve. That guy in DC would never have burned a flag if it wasn't for Trump's executive order.

I wonder if those cops go to work every morning thinking "what kinda ridiculous crap am I gonna have to deal with today because POTUS did something stupid yesterday?"

When HT was a cop he went into work every day thinking "I hope something goes down near the food court today, cause I could really go for an Orange Julius."

I agree with this.

I also think that doing a burnout on a queer-pride painted crosswalk should be protected by the First Amendment.

Hillary Clinton once called for flag burning to be banned. Not as much uproar then, I suppose.

That was BT. Plus she was lying.

I can't remember the reaction on the left at that time. I am pretty sure I spoke out against it.

She was on the wrong side of that issue as she was against gay marriage.
