Seriously though, it'll be interesting to see what happens with her nomination. How much will the Republicans fight it? They could use this as a chance to fire up their base before the midterms, but a really tough opposition would also play into the Democrats' strategy of portraying Republicans as the party of "no".

Let me just also say that I think this was a good nomination from a strategic viewpoint. If she makes it to the bench, Kagan has a much better chance of swaying Justice Kennedy to her viewpoint than a liberal firebrand would. She was pretty popular with conservatives when she was dean of Harvard Law School. I think Obama was looking for a consensus builder to counter Chief Justice Roberts on the right.

This continues the precedent with Ginsburg, Sotomayer, and that Edith Bunker wannabe that Bush nominated that only women who are butt ugly can serve. They set a bad example for young women who are hot.

 

On the plus side, John Goodman's sister seems really thoughtful, bright and has a sense of humor.

 

We'll see what happens. With every Supreme Court vacancy, I'm always hopeful we'll get somebody willing to go the extra mile to outright ban affirmative action but what I'm expecting here is a cookie cutter liberal.

She is more towards the middle than the left. Some folks on the left don't like her, which is why she will probably be a good choice.

I also think its hilarious that her 'pedigree' is the wonderful work she has done under Eric Holder, the most incompetant Attourney General we've had in a long time...

From everything I've read about her, she will be confirmed. Unless something weird or troubling comes out the Repubs will question her (like everyone should), but ultimatley not put up any kind of fight. It could've been much worse coming from the ultra liberal President. She seems more middle left than far left. :music_guitarred:

Based on her biography and life experiences, I'm detecting a full dose of east coast liberal elite radiation. She just plays the game nicer.

It'll be interesting to see how that statement comes back to haunt her during her own confirmation hearing. The interesting thing is that Kagan was right when she said that, but at the same time it is political suicide these days to actually answer the questions posed at these hearings. All the other side wants is a 5-10 second sound bite that will make the rounds on the evening news and get people up in arms. They don't care about the context in which you state your beliefs or any justification that you may give for them. That's why you can't risk getting torpedoed by giving a real answer.

Up until the 1980s, it was quite routine for Presidents to appoint Supreme Court Justices who had never been judges before. Some of the most distinguished Justices in history fit into this category (John Marshall, Thurgood Marshall, Earl Warren, Joseph Story, Hugo Black, Louis Brandeis, William O. Douglas, etc.)
