That is how Smith brilliantly got around the SCOTUS ruling so that Trump can still be convicted of these crimes.

Not one bit intimidated by SCOTUS' immunity ruling, Jack Smith digs in:

"Although the defendant was the incumbent President during the charged conspiracies, his scheme was fundamentally a private one. Working with a team of private co-conspirators, the defendant acted as a candidate when he pursued multiple criminal means to disrupt, through fraud and deceit, the government function by which votes are collected and countedโ€”a function in which the defendant, as President, had no official role." https://storage.courtlistener.com/recap/gov.uscourts.dcd.258149/gov.uscourts.dcd.258149.252.0.pdf

There is ample history and precedent for the legality of appointing a Special Counsel,ย goingย back for decades to Nixon.

In fact, it older than that, with the first one appointed in 1875.

Appointing a special council is fine, but it is requires the consent and approval by the Senate, which he was already ruled in one case Jack Smith was not legally appointed and thus lacks authority.ย  ย
