The last defense attorney for the defense was outstanding.

The DA attorney presenting is pretty horrible.  If this guy was a public attorney, I would beg for a new one.    Fani may be motivated to try to save this.

That is scary if that last attorney was the best the DA's office had.  There are two main issues Fani could get nailed on:

1. Fani received at least $17,800 in gifts/benefits from Mr. Wade in terms of vacations.  Fani signed sworn statements every year stating she has not received any gifts over the course of the year exceeding $100 from prohibited source (people she gave contracts too such as Mr. Wade).   IMHO, that should be enough, but this judge could rule that is more of an administrative issue and not an issue which is disqualifying for the purpose of this case.  Unless the judge finds Fani and Wade's story about cash payments was a lie.

2.  If Fani and Wade lied to the court on when their relationship started.   Had they been truthful, they might have skated and the court may have blown it off.   Obviously Fani skated the county regulations to award a huge contract to her lover.  It would have been a more administrative issue, that could have been resolved behind closed doors by friends of Fani.    But if it is determined that it appears Fani and Wade lied, the court will be forced to disqualify her for the appearance of impropriety.  

This is a pretty unique case, so it is not clear what the standard for proof is.   If it is propanderous of evidence, Fani needs to be booted.   If it is beyond a reasonable doubt, the judge may wimp out and say the evidence does not rise to that level.  

It should be just a preponderance of evidence, so Fani should get the  boot.  The judge said it will be about two weeks before he reaches a descion.
