The 14th Amendment doesn’t say that all persons born in the U.S. are citizens. It says that “all persons born or naturalized in the United States and subject to the jurisdiction thereof” are citizens.  The Supreme Court has never clarified exactly what they consider the bolded to mean.  What we do know is that children born in the US to foreign citizens are always subject to the jurisdiction of the their parents' foreign country (ie - they are citizens of that country).  We know for sure that the bolded exempts children born to foreign diplomats.  They can't be citizens because they are immune to US laws.  It's a gray area as to whether children born to illegal aliens or tourists were meant to be granted citizenship.  The State Department, through Executive fiat, has ruled on it, and as we know they grant American passports to such children.  But th Supreme Court is ultimate arbiter of this question and they have never officially ruled on it.  Hopefully they will shortly, so we can finally get clarity on the issue.
