The argument goes that private businesses or individuals should be free to what they like, including discriminate. If a business openly discriminates then the public will punish that business by refusing to purchase its product. Thus the marketplace if left alone produces a better result than if people are forced to behave well. People resent being forced to do anything and it results in backlash against the minorities we are trying to help.

ETA:  My first paragraph is a great example of why the Left hated him.  He treated that kid like an intelligent young man who could grow to have complex liberal philosophical discussions.  The Left doesn't want that for black kids.  The Left wants them to hear happy things as they grow into the next generation of subservient voting block.

I posted it but it’s not a great exchange. The kid’s name is Knowa De Baraso, he’s a podcaster, obviously mature beyond his years. On the one hand it’s ambushing Kirk in the middle of some event or public place, on the other you’ve got Kirk giving a dismissive ’go figure it out it’ in response, which didn’t answer the question. De Baraso appears to be doing quite well & appears to have a bright future, so the stuff you mentioned doesn’t hold water in that instance. Also, De Baraso’s retort that he wouldn’t be there without the 64 CRA (educated, with a career) is succinct & arguably correct. We don’t know his background but obviously he does.

Kirk did not call for repeal of the CRA, but he framed it as “anti-white”.

But the guest calls for a fundamental reexamination - & I take it retooling - of the legal regime, & suggests that’d be impossible without repeal. He may be right about that. He also says there’s no “magic bullet” - IMO that meant there was *no way they were going to be able to repeal the CRA. Kirk switched to discussing the media, to me suggesting they stood in the way, but he might feel differently now. That speech he gave was in December 2023. A lot of alarming things have happened since then. If their leader instructed the GOP to repeal the CRA I think the Congress would do it. There’s nothing in Kirk’s commentary - it’s a beast, it’s anti-white, it’s ferocious, it’s a ***weapon - to indicate he would support keeping it. Honestly I don’t know why anyone who agrees with him would.

Also, if Kirk described himself as “very, very radical” then what were the “very radical positions” that Kirk expressed concern about?
