Yeah; the whole 6-10 games is just a guess on their part.

 

I'll be happy if it's only six games but if they reinstate him effective immediately following the agreement, I'll pass out from a loss of blood pressure.

I got to drop Devonte Freeman, Andre Williams (I own Jennings) or TY Hilton to keep Gordon. At this rate, I got to drop someone to at least find out what happens to Gordon. Who should I drop and why?

FOX Sports' Mike Garafolo predicts an eight-game suspension for Josh Gordon if the NFL and NFLPA agree to a new drug policy.

Garafolo's "educated guess" is based on information from a variety of sources. Garafolo emphasizes that things are changing "minute to minute." ESPN's Adam Schefter has reported the sides would like to reach an agreement by Thursday evening, but it's not considered a slam dunk.

Your hypothetical is bad. Criminal laws are only retroactive if explicitly stated so, and that pretty much never happens. All that matters is the law in effect at the time you committed the crime.

 

Same thing applies to NFL policies. If you offended when you took a positive drug test in 2013, the rules of 2013 apply. The appeals process does not change what rules apply.

 

That being said, the NFLPA could push for this new drug policy to apply to all current suspensions. This is collectively bargained, so it'll do whatever both sides want it to do.

 

So essentially if Gordon's positive test is the benchmark date for what year his suspension applies to, and his suspension gets overturned, wouldn't someone like Blackmon have to get reinstated too?

Per FilthyFernandez@nunyabiz.com Gordon's suspension will be overturned, he will be credited the 1st game with 202 yds receiving with 19 catches and 3 TDs.

Garafolo is speculating that it might be 8 games...and that this 8 game ban is the result of the special negotiation of Gordon. Garafolo calls Gordon's case "a special case"....it was unusual because of the timing of the suspension.....so it appears the NFL/NFLPA are in negotiations for a partial year ban of something like 8 games. There was some speculation that Gordon could sue the NFL....and Garafolo said they NFL may reduce the suspension if he agrees not to sue.

 

so effing crazy....

Depends. The only reason Gordon's would be overturned is because his positive marijuana test would now be below the new threshold. If Blackmon's isn't below the new threshold, then it would still count as a positive test. Potentially his suspension could be reduced, however, if the NFL and NFLPA agree that the new drug policy applies to the 2013 league year, and the new policy provides for less strict punishments for multiple-time offenders.

special case because he tested positive in 2013 season and was officially suspended in 2014 season.....(what I wrote above).....this makes it a special case that needs a special ruling, which is currently being hashed out.

8 games you might as well drop him now. If they announce 8 games before this week's games I will just drop him for RB depth.

The Blackmon suspension would not apply because all of it (the test and the suspension) occurred before the 2014 season. There are no other suspensions in the NFL that were like Gordon's.....i.e., where the positive test and the final ruling of the suspension occurred in two separate NFL seasons.

Not to mention he might not be up to speed when his suspension ends. And he didn't look stellar in the preseason either...

Well he has a DWI hearing no matter what, correct? So I'm just saying, based on speculation, he might still be out for longer than what's being referenced solely within the drug policy context.

As I said in part of a post earlier though.

 

Gordon has messed up a lot of the last year. He isn't a one time "oops" offender. I could see that being a sticking point as to him keeping a suspension of 6-10 games. After his last criminal offense a teammate tweeted out about how we need to pray for Gordon and think about him as a man, and not a player. Things got bad. I wouldn't be surprised if a suspension lingered past an instant reinstatement.

Yeah, that makes no sense. If he plays from week 9 on I'll do back flips. It went from a 5% probability to this happening so if I can get him 6 games before the playoffs I'd be ecstatic. Also, consider Cleveland's bye week is week 4 so you aren't losing him later on to a late bye.
