cbfalcon 825 Posted August 20, 2015 They should be testifying. I remember reading that McNally was interviewed 3 times by the NFL, then once by Wells. The league then cited his unavailability for a 5th interview as evidence that the Patriots weren't cooperating. It does seem strange that I'm not even aware of his version of what went down. Either I totally missed that, or it wasn't in the Wells Report. But the league is certainly aware of his version, so if it wasn't in the report, logic dictates that his version didn't incriminate Brady or the franchise. But this time they should be asked direct questions, under oath. They weren't under oath before. If they get up there and say they did it on their own, it's a wrap and Brady shoikd get nothing and be left to get on with his career.
NewbieJr 541 Posted August 20, 2015 The ball boys were not fired - they were suspended at the request of the NFL / Goodellis that what you heard on WEEI? Do you have a link to that? Because I heard all along that New England suspended them. And if they're fighting this, why haven't they brought them back? Or did they suddenly decide to cooperate? TD Ryan2 316 Posted August 20, 2015 ESPN issued a 7 year late apology I'm guessing this was related to a recent "Defelategate" discussions where an ESPNt female reporter was talking about how NE was punished in the past for "taped walkthru's"??? and this ties in a bit with what Cruzer was suggesting earlier in this thread - the idea that there will be a significant portion of the public (and apparently professional reporters) that don't actually know the facts, they will only know that "NE Cheated" and then they'll move on to read the next headline... and for many, this will become their "wrong" but "irrefutable" truth. Cruzer 1,995 Posted August 20, 2015 If this judge is looking at the evidence in this case, how can he possibly make a ruling without testimony from the ball boys? They are at the heart of this thing. If they testified that they did it on their own, I would accept that and presume Brady innocent. But if they don't answer questions under oath, this is all a farce IMO. M. Florio addressed this last week..... Said that Brady and his team should be careful of what they ask for. Re: these two would testify if it goes to court. Patriotsfatboy1 1,432 Posted August 20, 2015 M. Florio addressed this last week..... Said that Brady and his team should be careful of what they ask for. Re: these two would testify if it goes to court. That, and the fact that Brady himself, would have to testify about things that he might not want to have divulged in court. See Roger Clemens when he sued for defamation. Berman is not going to look for more evidence and more testimony. I don't even think he has that ability. What he is trying to determine is whether the process was fair and according to the CBA. As such, he is trying to understand why there are discrepancies between what the findings in the Wells report, what Goodell said when handing down his original ruling and what he said when he upheld his original penalty. IGotWorms 4,058 Posted August 20, 2015 I agree. They should be present and testify. I also think Jeff Pash should testify as well since he was the one who edited the Wells Report. These key individuals should have to come before the judge and give a testimony. I think you guys don't know how an appeal works, which is understandable. Usually there is no new evidence on appeal. All that be considered is what's already in the record. There are a few exceptions in certain scenarios but it doesn't sound like this is one of them. Especially since the appeal is on procedural grounds. The real question is simply whether brady received proper procedure and not whether he is actually guilty or innocent of the charges. Of course the strength of the evidence does come in as a tangential matter - it's part of the NFLPA's argument that Brady got smeared and railroaded by Goodell. But that really goes back to the procedural issue

NewbieJr 541 Posted August 20, 2015 https://www.facebook.com/AdamSchefter/posts/957919684260673 So let me get this straight.... The league asks the Patriots to suspend two employees which the Pats feel did nothing wrong, and they immediately comply. The league hands down a VERY harsh penalty of two draft picks and a million dollars, which team owner Bob Kraft says he's accepting and will not challenge.... BUT, the Pats feel they haven't cheated or done anything wrong. Is that what you and your fellow blind homers are trying to say?

It seems to me he's the one going over evidence, and once he starts that I feel it's his duty to go over all the evidence, and the ball boys testimony is evidence.
