I am unaware of it having been done before on a member who has retirerd from the House prior to the release of the file.  That I am unaware does not mean it has not been done, but only that I am unaware of it.  Do you have a link.  I would happily explore it to educate myself.  Regardless, I think he ought to be prepared to answer some very probing questions.  If the minority party wishes to confront him with witness stadtements, sworn affidavits from the lawyers for the accuseres I think that should occur.  I want all concerned under oath and under the penalty of perjury and at risk for defamation suits.

House Ethics Committee to meet Wednesday amid debate over Gaetz report

The debate over whether the panel should publish its report on Gaetz is heating up in the Capitol. Lawmakers from both parties are calling for its release for the sake of transparency and ahead of confirmation hearings, while others — including Speaker Mike Johnson (R-La.) — argue the final product should remain private because Gaetz is no longer a member of Congress.

Johnson reaffirmed that position Sunday.

“What I have said with regard to the report is that it should not come out. And why? Because Matt Gaetz resigned from Congress. He is no longer a member,” Johnson told CNN’s “State of the Union” in an interview. “There’s a very important protocol and tradition and rule that we maintain that the House Ethics Committee’s jurisdiction does not extend to nonmembers of Congress. I think that would be a Pandora’s box.”

The committee — which is known for conducting its business in secrecy — had been investigating for roughly three years whether Gaetz engaged in sexual misconduct and illicit drug use, among other allegations. Gaetz has denied any wrongdoing.

The probe came to an abrupt end when Gaetz left the House on Wednesday, since the panel does not have jurisdiction over former members of Congress. But the committee can still release its report into Gaetz if it wishes, a move that is rare but not unprecedented; in 1987, the panel released its report into former Rep. William Boner (D-Tenn.) after he has resigned from Congress.

 

I also have trouble taking any precedent cited by they GOP seriously.  There was no precedent for denying a President his SCOTUS nom a confirmation hearing until McConnell did that for a year saying it can't be done in a election year...then confirming Amy Comey Barrett after voting had already started in in 2020.

Thank you.  I only have the vaguest memory of Boner, and only becasue your link jogged my memory.  I think I will take a moment or two to refresh my memory.  Regardless, it is clear we both believe that Gaetz, like Lucy Ricardo, has got some 'splaining to do.

Looks like there may be other examples as well.  Murtha, for instance.  Interesting.  Well if there is not precedent that this is never done I say go with that.  Let's release this and wallow in the sordid details.  Me, I love sordid details as long as they are not about me and become known to my wife.

He wouldn’t do anything without Trump’s blessing so not sure about the implications there in terms of the Speaker.
