Trump wants to deport American Citizens to El Salvador

Can you link where “multiple courts labeled him as MS 13”?  All I see is one cop who was later suspended did, which to my knowledge was the only evidence ever provided.


How it started: we need to deport all these violent illegals that don’t want to work and contribute nothing to society!

How it’s going:  let’s deport this illegal that has a US citizen wife and kid, has been here for over a decade with no violent record and a steady job!

For chrissake the reason he was “labeled a gang member” in the first place was because he was looking for work outside of Home Depot!

It was alleged that he was MS-13 for 1) wearing a Chicago Bulls hat and 2) an informant in NY where he never lived.  It was never determined that he was in MS-13 and he denies those allegations.

He was a legal resident of Maryland, married to a US citizen with American kids.  No charges, no record, and he was sent to prison.

The govt admits it was wrong to deport him, the SC court ruled it was wrong and he should be returned, but Trump has covered that up and defied the court and you fell for it.

The truth: They’re defying a SCOTUS order to facilitate the return of a man with no criminal record they admit they mistakenly sent to a foreign gulag.

Frankly, even if you argue that the Supreme Court intended a narrower meaning of the word “facilitate,” the Trump Admin would still be in defiance of this ruling.

The Trump Admin is doing nothing to try and facilitate Garcia’s return. In fact, they’re doing the exact opposite.

Except that I didn’t bring up the question of public approval. It was @avoiding injuries who asserted that this was an 80-20 issue and liberals were on the wrong side. I thought that was wrong so I looked it up: I found several polls that all said the same thing. I didn’t find any polls that said differently so there was no cherry picking. I chose one and posted it. 

I did it to refute his assertion, but personally on an issue like this one I don’t care much about polling anyhow. If 99% of the public disagreed with me it wouldn’t affect my view which is: 

1. If this dude is an undocumented alien who is also a member of a violent gang, he shouldn’t be here. Deport him and I don’t care what happens to him. 
2. If he was deported by mistake, or if he didn’t get due process, that’s wrong. Everyone here, legal or illegal, deserves due process. He needs to be returned to the United States immediately, if only to get his day in court and then be deported again. 
3. if the Trump administration refuses to obey the court’s instructions on this then they are in contempt of court and people need to go to jail until they comply. 
 

It’s that simple to me.

They may be forced to make a further decision. First, however, a lower court is going to have act bravely. We’ll see if that happens.

The other day you asserted that logically this guy must be a gang member since he told the court that if he was returned to his country of birth a rival gang would kill him. That logic actually made sense to me too. But now we have learned that, according to him, it wasn’t a rival gang; he was recruited to be a gang member (like all young males in his community) refused  and was threatened with death. So it’s possible, if he is telling the truth about this (we don’t know) that he is not and has never been a gang member.

This is why due process is so important. It’s scary to me that so many people are just willing to let it go in order to achieve a result they approve of. Perhaps you think, as so many conservatives do, that the threat of authoritarianism from Trump is exaggerated, but this sort of thing is how dictatorships begin.

That is a fundamental part of our Constitution that some people here keep ignoring.

The Founding Fathers did not believe that the right to due process under the law should be selective and apply only to those who we like or agree with. SCOTUS affirmed that in a 9-0 ruling that Trump is ignoring.

If that guy was convicted that means he got his day in court, was found guilty, and now he goes away. Why should I weep?

And were I his attorney I would have made a similar new claim. (Calling it a clarification of the original claim, not an entirely new claim) I would have asserted his lack of command of english, being his non-native language, made nuance difficult.  I would now be asserting that he meant to say that the rival gang to MS-13 had threatened him stating if he is not with us he is against us and must, therefor, be MS-13.  I would have stated that his only choice then was to join a dangerous gang under coercion or to flee to a safe, democratic country where males are basically not forcibly conscripted into gangs (south america) or worse militias (had he been from Africa).  I nearly posted as much at the time as the evolution of the argument was predictable.

 

Me, I have no way of knowing his affiliations.  I also take no position on this matter other than to say that I do believe in minimal but fundamental due process even for non-citizens.  I believe Americans may have more process due them than do non-citizens, but our Constitution does seem to recognize that humans, as opposed to Citizens, all have some fundamental rights.  Now those fundamental rights are not cognizable by our Courts until and unless those humans get a foothold, even problably an illegal foothold in our country, but once they do they do, in my reading of the law, have some due process rights.  I believe, without looking back on my previous post, that i said more or less the same, that he was entitled to some due process, probably more than an administrative determination by the executive branch.  He was, at the very least, in my opinion, entitled to a review, an appeal of that administrative decision though in Administrative law I do believe that Administrative opinions are entitled to a presumption of regularity. (caveat - it has been over 40 years since I studied Administrative law in Law School so my memory may be less than accurate.)

I am patiently awaiting the Trump Administration to hire 10,000 or so new magistrates to work on expedited immigration matters.  It could be a good retirement gig for me.
