Judges get voted in. If you don't like how they sentence convicts, vote them out. The folks who pass mandatory sentencing laws are also voted into office. I'm not going to lose a lot of sleep over someone who was CONVICTED of a crime being sentenced to a term that was decided upon by a voted in legislature. It's funny, Gobble says judges are elected and if we don't like their rulings we should vote them out. Well, the people who decided on the mandatory sentences are elected too. They can be voted out as well and legislators who would repeal the mandatory sentencing laws elected. But that doesn't invalidate his point. What he fails to acknowledge is that without mandatory sentencing, and sometimes even with, judges have sentenced convicted criminals to ridiculously short sentences as well which is the main reason mandatory sentencing guidelines exist. Gobble claims people have been given unjust sentences because of these laws, yet he hasn't brought any example for us to discuss. If the choices are between a criminal getting a harsher sentence because of these laws vs a criminal getting a ridiculously light sentence because of the subjective views of a judge, I will go with the former. Judges in MA are selected by the Governor's Council, not elected...and they serve for life (or age 70, whichever comes first). The Governor's Council is elected, but I can only vote for my district. Not some politician who's passing sentence on every future case he knows nothing about. Sounds like something they'd do in the Middle East. Murder in the FIRST DEGREE!! Found guilty by a jury. What more is there? The reason it's mandatory is because some dousche nozzle liberal judges were extremely lenient and sentenced to ridiculously low time.
