I have to wonder, was the kid maybe mentally retarded or something, why in gods name would he run when the cop just told him they were looking for suspects with a gun? Guy was acting twitchy with his pockets and as it turns out did have a gun on him. A more complete video included in link below (at the 10:40 mark). The body-camera video of Van't Land and Evenson introduces some ambiguity into this analysis. It turns out that Bailey had a gun on his person at the time of the shooting — "deep within his basketball shorts," as Killmer put it. Misconception made by many... just because you are not a threat to the cops (i.e., running away from them), it doesn't mean you're not a threat to somebody else. The key is probable cause, not merely suspicion or common sense. This one is gonna be sketchy. To reach prob cause it has to be probable that a certain person committed a certain crime. Not that simply a crime was comitted. If that kid did in fact ID himself as Spazz, one could argue that PC had been reached based on that and the 911 caller. As for the shooting, cops can shoot fleeing people in the back. Its a narrow window, but legal. Tennessee vs Garner aka the "fleeing felon". Where the officer has probable cause to believe that the suspect poses a threat of serious physical harm, either to the officer or to others, it is not constitutionally unreasonable to prevent escape by using deadly force. Thus, if the suspect threatens the officer with a weapon or there is probable cause to believe that he has committed a crime involving the infliction or threatened infliction of serious physical harm, deadly force may be used if necessary to prevent escape, and if, where [471 U.S. 1, 12] feasible, some warning has been given.
