Teacher jailed for refusing to use gender-neutral pronouns is arrested after returning to school

Dismissed Christian teacher who spent 100 days in jail after refusing to use gender-neutral pronouns in trans row is arrested after returning to Irish school

Teacher Enoch Burke has been arrested for alleged trespass in a manner ‘likely to cause fear’ after returning to the school that has already dismissed him for gross misconduct.

Mr Burke, who has been involved in a long and ongoing battle at the High Court following his refusal to refer to a gender-transitioning student as ‘they’, was dismissed from Wilson’s Hospital School last week.

In a letter to him which emerged over the weekend, the student council told him his ongoing attendance at the school was causing huge disruption, was affecting learning and was a daily reminder to its LGBTQI+ students of the prejudice they experienced.

However, Mr Burke returned to the Westmeath secondary school yesterday – not just once, but twice.

He first pulled up at the gates in a car driven by his father shortly after 8.30am.

Uniformed gardaí arrived at the school in an unmarked car at around 11.15am and were met at the door by school principal Frank Milling.

Mr Burke was arrested in the school courtyard and was taken to Mullingar Garda Station at around 12.30pm.

But after he was released by the gardaí at around 2pm, he was driven by his father straight back to the school.

The school gates had been closed by then, and while standing outside he gave his account of events to reporters.

He said: ‘The gardaí came to this school this morning, and they came down this driveway and they pulled up and they greeted the principal, and he ushered them into his office.’

Mr Burke said they spent 45 minutes in the office, ‘and then they came out to me and said, “We have made a decision that you are trespassing in such a way as is likely to cause fear.”’

He claimed the allegation was ‘totally preposterous’ and that it had been made without any observation of the situation.

‘It is not trespassing to turn up at your place of work,’ he said. ‘I am an employee here and even the purported disciplinary meeting last week, that was conducted unlawfully… even that purported meeting with its purported dismissal wasn’t to take effect for months.’

He continued: ‘And then when it comes to “likely to cause fear”, that is an absolutely preposterous statement. It’s absolutely reprehensible that I would ever do such a thing, that I would ever put fear into anybody.

‘I’m the meekest teacher at this school. I was simply standing outside the door because I was obstructed from going to work by the deputy principal.’

He said he had been told by gardaí that they were preparing to send a file to the Director of Public Prosecution.

He said: ‘All of this is because I won’t accept transgenderism. It’s absolutely preposterous. It’s really very sad.

‘I’m here to do my work, as every teacher in the country and every civil servant and every employee has an absolute right to do.’

He then entered the school grounds when the gates were opened to allow a schoolbus in.

When he reached the school he was confronted by Mr Milling, who told him to stop and to get off the property.

However, Mr Burke remained where he was and it is understood that gardaí were again called.

A message sent to parents informed them that the gates were locked ‘for security purposes’.

It said the situation was controlled and advised parents to delay collection of their child until a later time than usual. Just before 4pm, Mr Burke was collected by his father and driven away.

A Garda spokesman confirmed: ‘A male was arrested under the Public Order Act 1994 and taken to Mullingar Garda Station. He has subsequently been released pending the submission of a file to the Office of the Director of Public Prosecutions.’

Mr Burke had lost a High Court bid last week to prevent the disciplinary hearing, held by the school’s board of management, which resulted in his dismissal.

He is still awaiting a decision from Judge Brian O’Moore on an application from the school to have him fined or to have his assets sequestered – temporarily seized. The school had made the request in response to Mr Burke’s continued contempt of court in refusing to abide by a High Court order that he stay away from the school while he was suspended.

He had been placed on paid leave by the Co. Westmeath school in August, following his objection to a request that he call a gender-transitioning student by their newly chosen name and the pronoun ‘they’.

Mr Burke has said he could not do this, as transgenderism did not accord with his Christian belief that there are only two genders, male and female, and he raised his objections publicly at a church service and a dinner.

When he continued to attend the school last term, it went to the High Court to obtain an order to enforce his suspension.

His refusal to abide by that order led to a three-month stay in Mountjoy, before he was released at Christmas without purging his contempt.

This compelled speech situation is the exact thing Jordan Peterson was objecting to when he initially gained his notoriety in Canada. Sad to see what has become of Ireland.

so if a group of blacks went to a woolworths lunch counter after they were kicked out for being black, youd arrest the blacks too?

He was suspended for not addressing a student who is transitioning gender with a new name and using the "they" pronoun.

While his suspension was in effect, he was prohibited from attending the school. He ignored the suspension and kept showing up at the school, resulting in a court order enjoining him from being on school grounds. He defied the order, which was legally trespassing and that was why he was arrested, not for refusing to use gender neutral pronouns.

But barrister Rosemary Mallon said the case was not about transgenderism, but about a teacher ignoring a lawful decision by his school's board of management to suspend him on pay pending the outcome of a disciplinary process.

Ms Mallon said the principal had serious concerns about how Mr Burke may act in the school, as well as concerns for the student involved and the entire student body.

She said the case was not about his beliefs but about his alleged conduct.

Looks like this guy is a menace, which is why they suspended him, and he's proved to be a menace by constantly showing up at the school in violation of court orders.  This dude is a problem.

terrible analogy, because woolworths is a public place and it's illegal to kick someone out of a public place based on their skin color.  Dumb pinko.

Sad state of affairs. Never thought it could come to this. I imagine that is something the Jews said at one time as well. And this is really widespread now. Jesus.

I am willing to use the pronouns "it" and "what" for the indefinitely and subjectively gendered.  I am not willing to pretend they are a plural when clearly they are not.  I am not willing to go against the obvious evidence of my eyes.  When the evidence is not obvious, i refrain from pronoun use.

you appear to be rudderless in terms of morals.  sometimes its all about being a public or private place, other times it isnt.  what should people get in legal trouble for when protesting social norms?  how can people know where they legally stand if you are all over the place with justice?

True, but it tends to go to the extreme and they lose the ability to reason.  Any questioning is treated as an attack.

Personally I think using “they” to describe a transsexual is rather absurd. My children scold me for this, but I can’t help it. I want trans to have all the rights and respect and dignity as everyone else, but I can’t call one “they.” And I don’t approve of suspending a teacher who refuses to use that term. 
 

That being said, I have no fear of Auschwitz for those of us reluctant to say “they”. You really need to get some help.

"it" is a lot more appropriate in a lot of these cases.

Related note, if I get one more email with someone's preferred pronouns in their signature I'm going to go punch whomever it is in the face.

It won't be gas chambers.  It was be more like a virus causing mass deaths, but the correct people will be given the vaccine.   We are ceding power to unelected elitists who fear global extinction from global warming and truly believe the planet is grossly over populated.  The solution is pretty obvious, and if you don't think they can rationalize it, you are sorely overestimating human beings.

No, but because this is where we are headed.  You give a million bureaucrats billions of dollars, with incredible unchecked power and that power becomes more and more and the abuses get larger and larger.  We have lost control of our government and there is no easy way to get that genie in the bottle.  Sorry, I don't trust those bastards who want to take our speech rights away, who want to spy on us and collect data, who wants to raise our kids, who wants to put us in indefinite lockdowns, who wants to control our media and deplatform people who disagree with their agenda, who wants to harass parents who speak out at school board meeting.  No, I don't trust those bastards one bit or what these power hungry bastards will do as they accumulated even more power.  Our government does not deserve any trust which is why trust in government is down to around 20 percent.   These same folks are worried sick about overpopulation and are certain of global catastrophe from their global warming boogeyman.  The only logical way to save the planet under their beliefs is de-population.  And they are in position to do it.

Jonny, people will never be prosecuted in California or Oregon just for refusing to use the PC pronouns. They may lose their jobs like this chap did in Ireland (which is the best example you folks can find 🤣) and face consequences for trespassing on school grounds after that, but we will never see a prosecution for that. Never.

The forced speech laws are passed in NYC for sure and likely elsewhere but last I heard - a couple of years ago - they were tied up in courts, likely a ruling has been issued by now.
