They could have just told her to leave, which apparently one guy did just before a different one told her to get out.   I’m sure people here will say, “no, she needs to be prosecuted for being un-American!!!” but from what I’m seeing DHS has been dropping a lot of these charges when they’re trying to prosecute people for minor stuff

I said from the start- all reports and the initial video have her getting told by one office to "get out of here" and by the other to "get out of her car."

Again- she handled things badly. The ICE agents did as well. It ended in her death.

We don't know if there was any contact prior to the videos we see.  We can determine that she didn't start to leave when the first officer told her to get out, and her wife yelled to drive only when the officer reached for the door handle.  We'll never know if more words would have worked; my guess is not so much, your guess is that she would have agreed to move I guess?

My question is more in the hypothetical; let's say beyond all belief she chooses not to move despite a request to move.  What do the officers do then?

I'm fine with prosecuting her, not because she was Un-American, but because she was violating the law.

Prosecution is what competent officers would have done if they couldn’t de-escalate. I don’t think most people would have had a problem with that. And you mention “if they couldn’t get her to move” - well… moving is what inspired them to kill her.

I posted a video analysis above showing that Ross was not actually in front of the car. His legs were well outside its path, and he was leaning on it with his arms. Another point, the video from his phone led some people to believe he was hit. But they show frame by frame synced with other video that he was just fumbling his phone.

Inspired was the wrong word, my bad…

They wanted her to move, but when she did so she ended up dead.

As for murder, it need not be premeditated… that’s 1st degree. If she angered him and that’s why he fired (crime of passion), that could be motive for a 3rd degree charge.

If he just panicked when the car started to move and he was slipping a bit on the ice, one could argue negligence as the reason for the killing, which could also qualify as 3rd degree murder. (Negligence due to not following his training and having his gun un-holstered in the first place)

Yeah, if she lived through the gunshot, she should have been charged with attempted murder. 

Thank God the officer neutralized her threat before she killed someone.
