Yea the people on the train, but he had over 40 incidents prior to this one….

It’s not unlike aggressive driving, you can get away with it for a long time….but out there somewhere is a scenario that ends you….

The criminal picked the wrong person to fock with and now he is dead, and I actually feel really good about it 

I bet if there were a cop on that train the outcome would have been better, but hey we have to pretend cops are the problem…right?

I know…….accountability sucks…it’s racist….and expecting people to behave with some level of normalcy is racist….but if we don’t either make people stop being sh1tty or add more cops we will get more people handling it on their own

People shouldn’t pretend as if all cops are a problem. I don’t know if this is a position held by many people in government, I would not support that position.

Cops should certainly have extra scrutiny and be held to a higher standard however.

Who knows if he will be charged. After all, he’s a white Marine - so automatically a hero, right? And the guy he killed was black and mentally ill, so why will anybody care that he’s dead?

But if he is charged, I expect his lawyers might be able to get lesser charges by claiming he didn’t mean to kill him.

And a random sad irony about this tragedy: the victim’s mom was also murdered when he was a kid - also choked to death.

This mirrors what a lot of people are saying. Basically, yeah he murdered the guy, but they approve of the murder.

This is obviously a tragedy. People cheering for this guy’s death is messed up. He also appeared to be a menace and people going about their day shouldn’t have to put up with this. This is a failure of the system in NYC. 

The prosecutors in NYC have to take in all the eye witnesses info, the Marine and determine if they are going to press charges.This is a very complicated case.

More reports and video are coming out. Bystanders told the killer to stop, that he was killing the victim. He didn’t stop. The victim lost control of his bowels, which people told the killer, saying he’s about to die. The killer didn’t stop.

I think this killer needs to spend a lot of time behind bars.

I believe, if I heard correctly and the law was accurately explained, that in NY the reaction by the Marine has to be considered a proportionate response.

If there are people on the train who were telling him to stop that would seem to me to have some bearing in determining that.

If there are people who said they legitimately felt threatened that also has to be weighed.

Not surprised. Once a Marine is engaged, this is certainly a possible outcome.

Fock around and find out, of course he does this to the right color person and no one cares.

I have no difficulty whatsoever with the marine having engaged.  I would have had no difficulty if the engacgement lead to injury.  I do wonder, however, aboput continuing with a choke hold for that duration.  In light of the fact that the world is well aware of positional asphyxiation since george floyd one wonders why the marine and the other concerned citizens did not advance to othe4r tactics during the enbcounter.  Once the crazy was controlled they could have retrained him in ohter ways.  had i been there i would have suggested using mr. Crazy's shoe laces and belt to tie him up until the next stop.   In short I find the applicatikon of the choke hold appropriate, but the time of that application potentially inappropriate.

If that is true it’s going to change my mind on this affair. The attitude expressed by several people here that “yes it’s murder but I’m glad it happened” is not one that I can ever accept. I don’t regard it as a respectable position. If it’s murder then Penny deserves to go to jail. 
 

But I don’t think it’s murder. Not at this point. The bystanders telling him to stop would change my mind- if it happened.

OK I just read the full article. And what you wrote here is not exactly true. According to the article, one guy warned Penny that he needed to stop, and then another guy told Penny to stop and stand up, and Penny then released Neely and rose to his feet. 
 

You wrote “he didn’t stop.” and “the killer didn’t stop.” That would imply Penny knew that Neeley would die and meant for it to happen (making him, Penny, a murderer.) But that’s not what took place: Penny DID stop once the bowels were released and Neely’s  life was threatened and it was clear that Neely no longer was a threat. Which would go back to proving my initial conclusion: this was NOT murder and Penny did nothing knowingly wrong. 
 

That’s how I see it anyhow at this point without more information.

I don't know if it was murder or not, that's for a jury to decide.  But from what we know, it's not self defense, this guy was not a threat, and the marine did exactly what he was trained to do.

This is pretty much where I stand, without the typos.  :D  Seriously though, I think it is important to differentiate if it was OK for him to engage (I have no problem with it) vs. his skill at the choke hold:  we hear that he was a Marine and think oh, he knew what he was doing, he's a fighting machine!  Well, maybe, but that wasn't a very effective carotid choke.  If so he should have been out in seconds.  But Penny never cinched it with his other arm.  He certainly doesn't look like an MMA expert.

For the record I am not defending the murder, I'm not crying a river either. This guy was a criminally insane scumbag, it's hardly a loss. 

If it's proven to be murder then he'll do his time. The guy was probably on so much crack that his heart stopped.
