Hunter Biden to Sue Fox News

Lawyers for Hunter Biden plan to sue Fox News “imminently,” according to a letter sent to the network and obtained by NBC News. 

The letter, dated April 23, puts the Fox News Channel and Fox News Digital on notice for litigation claims arising from the network’s alleged “conspiracy and subsequent actions to defame Mr. Biden and paint him in a false light, the unlicensed commercial exploitation of his image, name, and likeness, and the unlawful publication of hacked intimate images of him.”

Should be interesting.  Justice Brennan wrote a good, even great opinion in N.Y.Times v. Sullivan.  His opinion protected free speech, even wrong and stupid speech against public officials to the maximum.  They had to prove actaul malice.  The opinion also laid the ground for defanmation suits by those who, while not elected officials, have thrust themselves into the public arena, into the lime light.  They can sue but in some ways they are public figures and subject to greater scrutiny in defamation cases.  As I recall Curtis (sp?) Publishing v. Butts expanded on that.  Most of the litigation in this area has actually been not elected offiicals but public figures, stars, often stars who became tabloid fodder.    Interesting whether hunter is a star, a public figure (I think so) and whether Fox is a tabloid (???)(Muckrackers have been given protection by the courts. Throwing muck on public figures may be the official American pastime, more so than overeating and watching sports)

I haven’t read exactly what Hunter is going with.

Looking at this solely politically he’s either a complete ingrate who just loves focking up his Dad’s stuff or he has some type of case.

I could see either being the case.

I don’t have the details yet but this strikes me as a BS lawsuit. Does anyone remember the film The People Vs Larry Flynt? If Hustler Magazine was able to repeat false rumours about Jerry Falwell, why can’t Fox do the same about Hunter Biden? Isn’t it the same principle? On the other hand, Carol Burnett was successful years ago in her suit against The National Enquirer. I admit I really don’t understand libel laws very well. 
 

One thing I know for sure: Hunter’s new attorney. Mark Gallegos, is super slimy.

IIRC the Hustler lawsuits were protected as free speech because they were meant to be obviously satirical, and because no one took Hustler seriously as a news outlet. This case is the polar opposite. Fox's infotainment business model may come under some scrutiny, specifically as it relates to a show they produced about "The Trial of Hunter Biden" which included a bunch of false information. But true to Fox's MO, it was ALL presented as fact.

This is all according to an article I read today. I did not watch the show.

I fail to see the connection between suing Fox news and opening oneself up to a suit from Trump.  What am I missing?  How does the one opne up the possibility of the other.
