The differences I see is BK was being accused of rape. He was to be appointed to a life long position on the SC. These noms are contentious under normal conditions. By going public, if it's true, let's get that part out of the way, if it's totally true, and with a massive platform, it makes you difficult to impossible to kill. 

Imagine when Tiger Woods got into his scandal, if Nike found out about all  those women BEFORE that all blew up in the national daily media cycle. Tiger Woods is worth billions to them. Or was. What would Nike do to silence those women?
