In the case of Ray Rice, it means that the Ravens running back cannot be put in jeopardy, a criminal prosecution, for punching his then fiancée. Even if the prosecutor tried to use different charges it would not be allowed if the underlying facts are the same. So, double jeopardy does apply and Rice cannot be charged again in the case. The NFL cannot increase Rice's punishment by claiming the league did not know the seriousness of what Rice did. First, who didn't know that Rice punched Palmer while in the elevator? Did anyone really think she fainted? Second, the punishment has already been decided both in court and by the NFL and partially served by Rice. The two clearly aren't related, but it makes the Gordon suspension seem absurd. Hopefully this plays into the I going NFLPA negotiations on that issue. Rotoworld reporting that the NFL HAD NOT seen the video (hard to believe, willful blindness perhaps?) and can "re-open" the case against Rice. I bet both Rice and his wife made statements to the league that are totally contradicted by the video. That may be the hook the NFL can use to jack up the suspension. famousb 11 Posted September 8, 2014 I don't know if the CBA says something about not revisiting suspensions, but double jeopardy sure as hell doesn't apply I don't thin DJ applies either, BUT I think Rice could easily get a court injunction for any additional suspension handed down by Goodell at this point based on the underlying principles. Rice throws a left hook to Palmer's face, knocking her out cold before dragging her limp body out of the elevator. Multiple media outlets have suggested that the NFL could re-open the case against Rice. He's eligible to return to the team on Friday, following the Ravens' Week 2 game on Thursday night. A suspension of 2 games was the precident set by previous instances. Once he felt the heat, Our Feerless Leader changed that precident going forward to be 6 games and then a year minimum. But previous instances had been two games. Seeing or not seeing the video does not change the facts as they were already known - namely, he hit her, knocked her out, and dragged her out of the elevator. The NFL isn't going to come back and say "Well we didn't know he hit her THAT HARD!" It does put the NFL in an uncomfortable PR situation. The can either play the we didn't see the video card. That is ridiculous considering the casino said they had handed over the video footage. They can say that the punishment fit the crime which doesn't add up. Damned either way. I'm pretty sure a leaked Josh Gordon getting high video would show him laughing hysterically to late night slap chop infomercials. The fact that the NFL offices are saying they didn't see the video opens the door for potential revisit of the initial 2 game ban.
