Alvin Bragg promises not to prosecute theft to establish 'racial equity' balance: 'Crime of poverty'

Manhattan District Attorney Alvin Bragg said during his campaign that racial equity needed to be a priority and that he didn't believe thievery should be prosecuted since it was a "crime of poverty." During the May 2021 meeting, Bragg articulated his intention to focus on racial equity instead of prosecuting theft. .....Alvin Bragg says it is ‘morally indefensible’ to enforce crimes that disproportionately affect Black people. Bragg said his overall intention was to "Shrin[k] the footprint" of the criminal justice system. ....A campaign webpage, which has since been scrubbed, said Bragg believed crimes that disproportionately incarcerate Black people are "morally indefensible" to enforce......

"These cases do not belong in criminal court. The punishments are disproportionately harsh, and fall disproportionately on the backs of people of color. This makes them morally indefensible," Bragg stated on his website. "This is why I will not prosecute … I will either dismiss these charges outright or offer the accused person the opportunity to complete a program without ever setting foot in a courtroom....In Manhattan, every single step in the way a case is processed from what someone is charged with, to the plea they are offered, to the sentence they are given, is rife with racial disparities...."

The New York City Police Department released data showing New York City's Five Boroughs being overrun with a handful of thieves who were arrested over 6,000 times, and released back into the streets. During the meeting, Bragg also promised he would create a fracture between the New York City Police Department and the Manhattan DA when he was elected. ....The statements reflect those from his chief prosecutor, Meg Reiss, who was brought in to Bragg's office. Reiss has advocated to include a critical race theory framework into prosecution years before joining the Manhattan DA.  .... Before joining Bragg's office, Reiss created the Institute for Innovation on Prosecution which suggested prosecutors should intentionally undermine the charges police officers bring forward....The institute said prosecutors must focus on "acknowledging our nation’s shameful history of slavery and racism which continues to cloud the criminal justice system."

I am surprised that he is willing to admit his racism in this way.

I would hope that there would be plenty of people across all segments of society who would stand up to his despivable racist comments.

I'm certainly open to discussions about reforms in the criminal justice system; problems like sentencing disparities.

But at the risk of invoking Chesterton's Fence again, we have a criminal system which until now has worked pretty well.  That system is adversarial by nature.  When evidence is discovered of a crime committed by a specific person, the government does their best to prove guilt.  The defense does their best to prove innocence (or disprove guilt, whatever).  A jury decides.  A judge oversees.

For the government to abdicate its part in the system is sorta like if the public defenders said "we think too many criminals are getting off, so we're going to stop defending them well."  It breaks the system.

To simply excuse recidivist criminals because you don't like the numbers accomplishes no good for society.  It is the "equity" approach to the perceived problem.  It is arguably acceptable, even laudable, to have equity as the end (or stretch) goal, but as the means, it is an utter failure.

Scenario....

Two competing shoe stores next to each other... Reebok & Adidas (for example).  A black person goes into one and steals 5 pairs of shoes valued at $800, and a white person goes into the other one and steals 5 pairs, also valued at $800.

 

Questions...

  • Is Bragg going to prosecute the white guy and not the black guy?
  • If so, does the white guy have a racial discrimination case against Bragg and the city?
  • If not, isn't he openly saying that every person is free to steal whatever they want?

So in the mind of Alvin Bragg......"black people" committ crimes disproportionately......and are therefore inclined to criminality because of their skin color.  It is unfair to hold "black people" to the same standard as every other group in society, so we must allow them to do what they do....and engage in criminal behaviors....

Exactly, which is why I asked the questions.  If a white person and black person commit the same crime and he only prosecutes the white person, he's saying that white people don't commit as much crime, so he can prosecute them.  At that point, that would be racial discrimination because the sole reason for the prosecution, is race.  I mean, liberals would at least have even more proof of systemic racism in Democrat monopolized areas (that they will continue to ignore).

Everything within liberlism is about discrinimation.  They pretend to be moral and virtuous and only interested in helping those who have struggled.  But the reality of their actions is that they do not beleive the people they pretend to care about are equal to anyone else.  They never fix a "problem" they simply attempt to change the system to a lower place to allow the problems to exist without accountability. Then puff out their chests as if they accomplished anything.

Even though he is a racist, how does he act like there are no victims? If the victims were white, it would be in line with his racism. But they aren’t. He feeds his own people to the wolves for his a twisted ideology that people actually ask for. Victims are a nuisance to them, as we saw  last week at the congressional hearings in NYC. They didn’t GAF about those victims that told their story. They are in the way.

There is certainly truth in this, but it is also true that white elite NIMBY liberals have the "luxury belief" that it is a great idea to elect the guy who will be nice to the poor negroes over there, while they live insulated in their nice neighborhoods and safe highrises with doormen and 24/7 security.

The problem extends much further than Bragg. You go up the food chain a little in NY and you see the disturbing patterns in play. New York AG Tish James left average tax paying New Yorkers to be prey to relentless career criminals by woke "bail reform" Didn't do a single damn thing about it.

Until she lost up to 16 points in approval rating in the span of just 2-3 weeks time. And risked losing her reelection bid. James had an estimated 3 million dollar campaign financial war chest. Her opponent? Roughly 150 thousand dollars. Even with dark money and Soros money pumping into her coffers, she couldn't escape voters who were tired of seeing NY turning into a safe haven for criminals for the sake of woke.

So the ones they will lock up will likely and eventually be bailed out. To hunt down more innocent New Yorkers.

You can serve this great nation in our Armed Forces. And if it means fitting Bragg's agenda, he will still let your killers get off as light as possible. As long as they are black and fit his personal "narrative", that's clearly been bought and paid for by Soros money. What about Hason Correa's three children that were orphaned? Bragg doesn't give a damn. There's no Soros money in protecting them and thinking about what kind of life they'll have without their father. 

Even if there is video evidence. Even if you have 33 witnesses. That apparently doesn't matter at all. If you don't fit Soros and Bragg's "narrative", then you apparently need to die at the altar of identity politics. 

How offensive is it that Correa served our country in uniform to help defend the "freedom" that Bragg exploited to go light handed on his murderers.

This system continues to fail us. We are not safe anymore, not even the members of the service. I know you were tired of these laws, especially the ones from the new DA. Eric Adams hires his former landlord to a cushy nepotism job paying 241K a year, where she's seeing ghosts and accuses everyone of tapping her phones. Her job? To help NYPD morale. And what is actually happening? Combining Bragg with Adams and Hochul, then throw in a little AOC, and having remnants of the Andrew Cuomo/Bill deBlasio legacy, and look at the mess that is now New York in terms of basic civil order. And how is morale now with cops leaving in droves?

She has the goods on Adams. He actually lived in New Jersey so she “rented” him a room in her apartment, giving him legal residence in NYC. She’s gonna be fine. Lateral move at worse or she lands something in the private sector from a donor. Just another NYC grift.

Manhattan DA to stop seeking prison sentences in slew of criminal cases

Manhattan’s new DA has ordered his prosecutors to stop seeking prison sentences for hordes of criminals and to downgrade felony charges in cases including armed robberies and drug dealing, according to a set of progressive policies made public Tuesday.....In his first memo to staff on Monday, Alvin Bragg......

Assistant district attorneys must also now keep in mind the “impacts of incarceration,” including whether it really does increase public safety, potential future barriers to convicts involving housing and employment, the financial cost of prison and the racial disparities over who gets time, Bragg instructed....In cases where prosecutors do seek to put a convict behind bars, the request can be for no more than 20 years for a determinate sentence, meaning one that can’t be reviewed or changed by a parole board...

Many criminals will not face a prison sentence under the new Manhattan DA’s orders.....“The Office shall not seek a sentence of life without parole,” the memo states....Under state law, that punishment is reserved for the most heinous of murderers, including terrorists, serial killers, cop killers and fiends who kill children younger than 14 during in connection with sex crimes or torture.....

Armed robbers who use guns or other deadly weapons to stick up stores and other businesses will be prosecuted only for petty larceny, a misdemeanor...... Armed robbery, a class B felony, would typically be punishable by a maximum of 25 years in prison, while petty larceny subjects offenders to up to 364 days in jail and a $1,000 fine.....

Convicted criminals caught with weapons other than guns will have those felony charges downgraded to misdemeanors unless they’re also charged with more serious offenses. Criminal possession of a weapon in the third degree, a class D felony, is punishable by up to 7 years behind bars.....

Burglars who steal from residential storage areas, parts of homes that aren’t “accessible to a living area” and businesses located in mixed-use buildings will be prosecuted for a low-level class D felony that only covers break-ins instead of for more serious crimes. Those more serious crimes, class B and class C felonies, would be punishable by up to 25 and up to 15 years in prison respectively....

Drug dealers believed to be “acting as a low-level agent of a seller” will be prosecuted only for misdemeanor possession. Also, suspected dealers will only be prosecuted on felony charges if they’re also accused of more serious crimes or are actually caught in the act of selling drugs. That felony would mean facing up to seven years behind bars.

This article, at the end, brings up a very good point. It's Bragg's job to enforce the laws on the books. Not essentially push new public policy on his own based on what he decides is important enough to actually enforce without any practical oversight. If he wanted to create public policy or have the power to have discretion in areas of public administration, he should have sought out a different career and political path.

I would like to note to Mr Bragg that white men are disproportionately affected by crimes associated with corporate malfeasance.  Therefore, using his logic, he should end his pursuit of Donald Trump, in the name of equity....

For example, the Institute argued in a report, signed with Reiss' name, that prosecutors must focus on "acknowledging our nation’s shameful history of slavery and racism which continues to cloud the criminal justice system." About criminals, she has consistently argued for leniency and more understanding, including for those harming victims with violent assaults....

I promote "conservativism", I do not promote Republicanism because there's quite a bit about the GOP I actually don't like. There are a large number of Republican elected officials I think are idiots and shameless gutless grifters. And I believe there are many "traditional liberals" like a Bill Maher, who have more in common with many Conservatives than some hard line Republicans do. 

IMHO, no matter where you reside on the political spectrum, the first enemy is always the radical left. Because they are the ones pushing the policies most likely to get you and your children killed on the street. They are the ones trying to push sexualization into schools against young children. They are the ones who see a racist around every corner. They are the ones who wanted to normalize the rioting, burning and looting of 2020. They want America to burn and they want to see you dead. In the meantime, they will take trying to turn your kids into woke cannon fodder in the interim.
