RNC wins at 5th circuit to block mail-in-votes that arrive after election day.

 federal appeals court ruled that Mississippi’s law allowing mail ballots to be received after Election Day is illegal, a decision that escalates a consequential legal battle even as it may not affect the upcoming election. 

The 5th U.S. Circuit Court of Appeals’ opinion sends the Republican National Committee’s (RNC) challenge back to a lower court to determine whether the Mississippi statute should be immediately blocked or whether it’s too close to the election to do so. 

Even though the decision does not order any immediate changes to any state’s ballot deadline, it increases the possibility of the issue landing at the Supreme Court. Eighteen states accept mail ballots following Election Day as long as they are postmarked by then, according to the National Conference of State Legislatures. 

“Federal law requires voters to take timely steps to vote by Election Day. And federal law does not permit the State of Mississippi to extend the period for voting by one day, five days, or 100 days. The State’s contrary law is preempted,” Circuit Judge Andrew Oldham wrote for the unanimous three-judge panel. 

Oldham and the other two judges, Kyle Duncan and James Ho, were all appointed by former President Trump. 

Mississippi’s law allows for mail ballots to be received by officials up to five days after Election Day. But the panel of judges ruled that federal law overrides that rule.

The Mississippi debate is one of multiple cases that Republicans have filed challenging the practice of accepting mail ballots after Election Day. A federal court in Nevada found the RNC had no legal standing to challenge the state’s similar law, and the RNC is now appealing.  

“This is a major win for election integrity, upholding the law and commonsense ballot safeguards,” RNC Chairman Michael Whatley said in a statement. “Voters deserve nothing less than a fair and transparent election which ends on November 5th. We will continue to defend the law, fight for protection of every legal vote, and stop election interference in our country’s most important election.” 

The Hill has reached out to the DNC and a group of private parties that both intervened in the case to defend Mississippi’s law. 

Election officials have warned that voting by mail could face delays and significant disruption due to persistent issues they say the U.S. Postal Service has failed to address. 

In September, groups representing election officials sent a letter to Postmaster General Louis DeJoy claiming that mailed ballots postmarked on time were still received days after state deadlines passed, nullifying those votes.  

DeJoy said in response to the letter that election mail “routinely outperforms” other mail. 

Postal Service records show that roughly 99.89 percent of ballots were delivered from voters to election officials within seven days in 2020. In 2022, that figure rose to 99.93 percent. 

But thirty-two states require mail ballots be received by Election Day to be counted. At least 10 other states, including Mississippi, require ballots postmarked by Election Day to be received by election officials in fewer than seven days. And several other states set seven days as the deadline. 

DeJoy said in the letter that he is “confident” in the Postal Service’s preparations for November’s contests. 

About 43 percent of American voters cast their ballots by mail in 2020, and 31 percent voted that way in 2022.

That is a ridiculous ruling. It should be sufficient that it was postmarked by election day.

I think the entire argument should have ended with one judge saying "The Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each State by the Legislature thereof." now GTFO of here RNC with this BS.

The only mail in ballots should be absentee ballots. And those should be reserved for deployed military and possibly citizens working out of the country long term. 

Everyone else should vote in person, on election day, with I.D.

While I understand the need to compete under the current rules, I'm consistent in my belief that we should do everything in our power to ensure the integrity of our elections and in person voting, with I.D., is the best way to do so.

Well, fortunately, an idiot like you isn’t running things. Seems pretty reasonable to expect people to mail in their votes in a manner in which we can have a timely counting of the votes - you know, so we don’t descend into chaos with new votes dripping in days after the election.

The fact that your average everyday joe can mail in a vote is crazy in the first place. Mail in should be only for absentee balloting. And there is a reason they want an END DATE to voting. It's so it's not drawn out and less easy to cheat. Who actually cares and can't get their ballots placed on time? If they can't get it in on time, then they are not responsible voters in the first place. I think you are just talking to a website troll.

Register to receive a ballot. They mail it to you a couple weeks before. You fill it out sign it and tear off a tracking code. You drop it in ballot box or mail. You double check it was received a couple days later with tracking code.

This is how all states should do this. 

If people want to go to the community center and wait an hour knock yourself out.

In any case that is what the tracking code is for. I have voted by mail for years and the ballot has never been lost.

Had my signature challenged once IIRC.

When I see these vids of people standing in the rain forever to vote I just don’t get it. I kind of assume this is on purpose to make people not vote TBH.

If you're too lazy to go to the polls to cast a vote on election day, you don't deserve a say in how the rest of us are governed. Keep your lazy ass at home and let those of us who care do the heavy lifting for you.

Oh, now it's not only an hour long wait, it's raining too. Sure thing. 

I live in a highly populated area. Last presidential election, I stopped at the polling place on my way to the local grocery store. Walked right in and voted with no wait. Was given the ballot, showed my ID, and was pointed to a table. I checked my vote and put it in the box and carried on with my day. Took me literally less than 10 minutes to park, walk in, vote and walk back to my car and carry on with my day. 

You all just make stuff up to try to turn it into some kind of drama that's non existent.

I hear that if you need to go in person to vote you need to fight a pack of wild dogs during a tornado with lightning blazing around and snipers trying to take you out. Oh and they are loudly playing Afternoon Delight the whole time outside the doors to the polls over and over again. Go Starland Vocal Band.

Mail-in is much better. That all the states haven’t figured this out yet is insane. Or they want to keep voting down. Who knows?

Let’s try this again. Someone explain why this shouldn’t be the way everyone in the US votes.

Register for a mail in ballot (we can bicker about what this process is but for the sake of forwarding the discussion let’s just say it is whatever your state currently requires to vote in person), they mail you a ballot by 3 weeks before Election Day, you also receive a voting packet explaining the various initiatives, candidates, etc., you fill out at your discretion, you sign and tear off a tracking code unique to your ballot, you return by an agreed upon date that is clearly marked on the ballot (we can just agree this is by Election Day), you can double check your ballot was received a few days later.

Why wouldn’t people want this system?

MS, LA & TX. I was going to say it won’t make a difference but TX might hopefully be in play this year.

The cutoff should be earlier for mail-in ballots. The way the ballots get handled through the usps system is kind of crazy. There are no official rules on handing them. You have carrier employees, medical , pensions etc , who for the most part are extremely trustworthy. Then there is the temp carriers , CCA city carrier asssstants who are low paid and really no benefits and I wouldn’t trust them to walk my dog. The washout rate is about 50% within 90 days, you get good ones boy do you get bad ones and language can be an issue. I had a supervisor working the last week of the election from 7 am to 9-10 pm. A total 💩show. Everything is decided on the fly.

This is a small quibble in the overall system. 

I actually just busted out the ballot and have begun filling it out in past few minutes. They have added opt in texts to track my ballot, they have added a signature verification page along with a ton of other info. 

Happy to pay some tax dollars to make this happen. Should be nationwide.

Let me educate you; you are in sore need.

I used to live in an extremely remote area. Almost everyone voted by mail because most residents of the county were at least a 45 minute drive in perfect weather to the polls on narrow, twisting mountain roads. If snow were to fall on or near election day, those people may not have an opportunity to vote in person. This is not a big deal, fraud was/is not a problem, and nobody gave a fock until turnip decided he couldn't bear to lose and turned it into a shlt show.

Took me more than 30 minutes just to fill out my ballot.  Federal, state, local races, judicial retention, a dozen or more ballot questions and initiatives.
