It's why the prosecutor was only originally going after murder 3 but my understanding is they've changed their minds and are raising the charge to murder 2.

The drugs are material because you need to look at the other officer's actions. If they respond to a 911 that indicates a guy is acting like he is on drugs, then the cops will have a heightened sense of danger. If they interact with the suspect and he shows signs that he is on drugs, then they are going to use more force to subdue the suspect. Remember, they want to get home too at the end of the day.

With that said, and HT alluded to this, LEO's across the country agree that what happened while Floyd was subdued was not proper and worthy of criminal charges.
