Quite a contrast in coverage and perspective flipping back and forth from MSNBC and Fox last night.  

 

So I watched his speech.  He was aggrieved, as expected.  He lacked any real fire, and why not, it was a long day.  Me, I thought he lacked fire because one can only motivate themselves to give the same speech so many times before even they get bored.  I did note the crowd as he waddled in.  I saw Kari Lake, MYTG, and to my amusement the My Pillow Guy.  They were all beaming and craning their necks to get even a bit of recognition and face time. I did not see Melania.  I may have missed it.  Is she standing by her man or not?

That was discussed by the guy at listened to as well in that article. It’s crazy to me that is up to interpretation and not settled by now. They couldn’t do this so this when he was President so it makes sense that the clock would be stopped but I’m sure this argument will be had.

This guy is always pressing random laws and norms it seems. I get the position of Prez should have tons of latitude, when a jackass is in the job it really tests the system. Same kind of odd (to me) arguments were made at his 2nd impeachment. Only thing that kept he from being convicted by the Senate was that he lost and was no longer going to be Prez.

Using this logic, do whatever you want just before becoming Prez - 4 years later they can’t touch you. Do whatever you want in the last few months if you lose re-election they can’t touch you then either.

In any case the point being made is about this statute of limitations argument and that it wouldn’t matter…you can’t go after the Prez when they are in the WH. So ride out the time while in WH - clock is running the whole time. 

For impeachment - same for if you lose in November. Do what you like until Jan 20 and it’s all good.

Many courts will tolerate a demand for a Bill of Particulars ahead of the briefing schedule as that information is necessary to file and brief motions.  I have no idea how receptive this court will be to that.

 

I do think the court and the D.A. are going to have increasing concerns with Trump's behavior over the next few months if last evening is a precursor of what's to come.  They may be tempted to try to bring him or his attorney's back in for further instriction.  That would be a circus.  It will be interesting to see if they can endure this process.  Trump will have his challenges in this matter, but so too the Court and the D.A.

From the stuff I have seen the DA will need to be more specific about each count and what his arguments are for indictment. Team Trump will and should ask for that. 

The second paragraph about how to handle Trump running his trap will be another of these issues he will push the boundaries of IMO. Only because he is a candidate and ex-Prez will he be able to get away with the stuff he does in regards to talking about the judge, the process, etc.
