Lunatic Alabama Supreme Court: frozen embryos are children

An Alabama Supreme Court’s ruling that frozen embryos in test tubes should be considered children has sent shock waves through the world of reproductive medicine, casting doubt over fertility care for would-be parents in the state and raising complex legal questions with implications extending far beyond Alabama.

On Tuesday, Karine Jean-Pierre, the White House press secretary, said the ruling would cause “exactly the type of chaos that we expected when the Supreme Court overturned Roe v. Wade and paved the way for politicians to dictate some of the most personal decisions families can make.”

Speaking to reporters aboard Air Force One as President Biden traveled to California, Ms. Jean-Pierre reiterated the Biden administration’s call for Congress to codify the protections of Roe v. Wade into federal law.

“As a reminder, this is the same state whose attorney general threatened to prosecute people who help women travel out of state to seek the care they need,” she said, referring to Alabama, which began enforcing a total abortion ban in June 2022.

The judges issued the ruling on Friday in appeals cases brought by couples whose embryos were destroyed in 2020, when a hospital patient removed frozen embryos from tanks of liquid nitrogen in Mobile and dropped them on the floor.

Referencing antiabortion language in the state constitution, the judges’ majority opinion said that an 1872 statute allowing parents to sue over the wrongful death of a minor child applies to unborn children, with no exception for “extrauterine children.”

“Even before birth, all human beings have the image of God, and their lives cannot be destroyed without effacing his glory,” Chief Justice Tom Parker wrote in a concurring opinion, citing scripture.

Infertility specialists and legal experts said the ruling had potentially profound effects, which should be of concern to every American who may need to access reproductive services like in vitro fertilization.

Saying a late term child in the womb  isn’t a child is worse. Much worse. I don’t know why the left does that.

Lol you liberals don’t really care about this other than the fact that it might make it more difficult for you to kill babies. That literally is the end of the list of why you would care.

Has there ever been an aborted child that was happy with that decision? I know there are many children born that are happy that they weren’t aborted. Most of them grow up to be adults.

in this specific instance, where the “parents” are suing for wrongful death because a rando destroyed the embryos, I guess you could compare it to someone killing a pregnant lady being charged with double murder even if the lady could still have an abortion, and thus kinda makes sense.

It seems the concern is more about applying this ruling in other ways.

I only read the OP, I couldn't read the NYT article.  I see a frozen embryo as property, because it's not in the woman and attached.  Going by what you're saying is in the article, then I think the proper route would be to allow the law be written to give the parents to decide the course of action.  If the parents want to say, "Nah, flush it", then that's what should happen.  If the parents want a wrongful death suit or murder, then that's fine with me too.

The problem with abortion is that both sides want and need, abortion to be a political football.

Abortion does not belong under the government purview.  I'm ok with governmental boundaries, but overall, individual rights.  Smoking, and alcohol are similar.  People have the right to smoke and drink... At that point, how Alabama sees the embryo's, should be acceptable across the board.  Meaning, an embryo outside the body has the same right to life as if it were inside the body.

If you had bothered to read the article, it discussed many reasons that healthcare providers and couples who struggle with fertility (not liberals) are concerned with the ruling :doh:

NYT articles are written by liberals who only talk to liberals.  Nothing more than a propaganda rag promoting the leftist agenda.  They're on par with The Enquirer.

The reason I don't have an issue with the law is because Alabama law states that an embryo inside or outside the body is life, hence requires the same protection.  If that's the foundation, abortion laws need to apply to both.  Neither the left or the right, are correct on the abortion issue, but at the very least, they need to be consistent.

The University of Alabama at Birmingham health system became the first organization in the state to confirm it is pausing in vitro fertilization (IVF) treatment following an Alabama Supreme Court ruling that found frozen embryos are children, the health system said in a statement to AL.com.

The system said it was “saddened” for patients interested in the IVF process.

“We must evaluate the potential that our patients and our physicians could be prosecuted criminally or face punitive damages for following the standard of care for IVF treatments,” university spokesperson Hannah Echols told AL.com.

Many abortion supporters believe that life happens when a baby is able to sustain itself outside of the womb. 

This means that most liberals are subject to abortion at any age, since they leach off of society long after birth.

I admittedly didnt really read the article.  I dont know what the laws are or who got sued.  

On the surface "protecting" frozen embryos is stupid.  What property people stole or destroyed...i didnt read.  

As HT randomly mentioned eariler....late term abortion is stupid as well as evil.  

In a vacuum both are stupid.  But I didn't read any fine print on this or as to why they are doing it.  Just sounds goofy as hell.  

Abortion is basically a non issue for me.  When it comes to voting it doesn't register.  I don't think the right should fight this abortion battle tooth and nail but thats coming from a political stance.   I myself don't care either way.  Don't abort babies late term, thats all I care about on this issue.

But you do understand that the Alabama Supreme Court IS the highest court in Alabama, yes? :wacko:

Highly doubt there’s a federal question for the US Supreme Court to take on here. Not after striking down Roe
